"The Gameloft Club" Terms and Conditions
The following subscription terms and conditions ("Terms and Conditions") are the terms of a legal agreement between you, on the one hand, and Gameloft Inc. (hereinafter referred to as "Gameloft"), on the other hand.
"The Gameloft Club" is a monthly-based subscription service which will be automatically activated when you confirm your subscription on Gameloft Mobile Site.
US AT&T and Sprint subscribers only. You must be over 18 and have permission from the bill payer to use this service.
3/ Subscription Service description
This subscription service allows you to download 2 mobile games according to Gameloft's catalogue for your phone for only $6.99 every month. (+ WAP connection charges). During the term of your subscription to the Gameloft Club, you will acquire two Gameloft mobile games credit per month. One credit is equivalent to one Gameloft mobile game. To access the subscription service and receive your first mobile game, you will have to click on "Subscribe" on Gameloft Mobile Site. You will then see a confirmation message, be charged and be able to choose the games you wish to download according to Gameloft catalogue and compatible handsets. Upon subscription purchase, games must be redeemed and downloaded within six months. Unused credits will automatically expire after 6 months, and upon subscription termination, accrued Gameloft mobile games credits will be void.
Your monthly subscription will be automatically renewed if not unsubscribed. You can unsubscribe at any time by simply clicking on "Unsubscribe" on Gameloft Mobile Site. Gameloft reserves the right to end the subscription at its will. If your subscription service remains inactive for a period of 24 consecutive weeks, your subscription will be automatically cancelled. You will receive a SMS notifying you that your subscription may be cancelled if you do not download a Gameloft mobile game for a period of 6 consecutive months.
5/ How to Opt-out: To opt-out of our SMS service, text STOP to 84149 and you will be unsubscribed from our SMS text messaging service immediately. We will send you an SMS confirming that you have been unsubscribed and you will not receive any additional messages unless you re-register on our website.
6/ How to get help or support: To get help with subscription issues, please fill in the form at https://www.gameloft.com/distribution-contact, or call our toll free number at 1-800-910-3186. From your mobile phone, you can request our contact information at any time by texting HELP into 84149.
The subscriber will be charged each month on his phone bill $6.99. The Subscriber will be billed at weekly anniversary date of subscription or of the last successful billing attempt. Gameloft offers new subscribers a complimentary month. The subscriber is not charged at the time of subscription for the first month. A user cannot subscribe to the Gameloft Club if they do not have enough funds on their account to renew their subscription in the following month.
8/ Personal data
In conformity with the Personal Data Act of 1998 the User has the right to obtain access, correct and/or oppose the communication of data held by Gameloft on their person on request by writing to Gameloft Inc., 45 West 25th Street, 9th Floor, New York, NY 10010.
Gameloft reserves the right to change these Terms and Conditions, including but not limited to the charges associated with the subscription service.
10/ Governing Law and Jurisdiction
These Terms and Conditions are governed by and construed in accordance with the internal laws of the State of New York. You hereby irrevocably consent to the exclusive jurisdiction of the New York courts (state and federal) notwithstanding the jurisdiction where you are based.
11/ Entire agreement
These Terms and Conditions override any contrary or conditions published by Gameloft in relation to any order placed by you with us. For help, text HELP to 84149. To unsubscribe, text STOP to 84149. Message and data rates may apply.
